AgentFlo Service Agreement
Please read the agreement below and sign electronically. This is required before we connect your WhatsApp and set up your assistant.
AgentFlo Service Agreement — version v1.0 (2026-07-04)
Between AgenticFlow (Pty) Ltd (reg 2026/404680/07), trading as AgentFlo (“Provider”) and the accommodation business completing this form (“Customer”).
1. The service. AgentFlo is an AI-powered assistant that answers guest enquiries and supports booking-related communication on your WhatsApp Business number. It does not guarantee bookings, revenue or occupancy, is not a property-management system or payment gateway, and does not replace your duty to supervise guest communication. AI responses may occasionally be incomplete or incorrect and you remain responsible for reviewing important guest interactions.
2. Electronic signature (ECTA). You agree to transact electronically under the Electronic Communications and Transactions Act 25 of 2002. Your typed full name together with the “I agree” tick constitutes your electronic signature and evidences your intention to be bound. We record your name, the agreement version, date, time and IP address as part of this acceptance.
3. Authority & accuracy. You warrant that you are a lawful South African accommodation business, that you are authorised to bind the business, that you own or control the WhatsApp number being connected, and that the information provided is true and complete.
4. Data protection (POPIA). Under the Protection of Personal Information Act 4 of 2013 you are the responsible party for your guests’ personal information and we act as your operator, processing it on your instructions to deliver the service. We apply reasonable security safeguards and will notify you without undue delay of any compromise within our control. Guest data may be processed on infrastructure outside South Africa, including Meta/WhatsApp, cloud and AI providers, and flows through the WhatsApp platform subject to Meta’s terms.
5. WhatsApp & Meta. The service runs on Meta’s WhatsApp Business Platform. You must comply with Meta’s WhatsApp Business terms and messaging policy, obtain guest opt-in where required, and honour opt-out requests. AgentFlo is a Meta Tech Provider, not Meta; Meta may limit, suspend or remove numbers at its discretion, and we are not liable for Meta’s enforcement actions.
6. Fees & term. Fees, billing cycle, term, renewal and cancellation terms are those shown at signup or in your order form. Late or failed payment may lead to suspension after reasonable notice. Full commercial terms are confirmed separately in writing.
7. Intellectual property. We own the AgentFlo platform, software and prompts. You own your business content and guest data, and grant us a limited licence to use it solely to provide and improve the service.
8. Liability. Neither party is liable for indirect or consequential loss (including lost profit, revenue, bookings or data). Our total liability in any 12-month period is limited to the fees you paid in that period, except for liability that cannot be limited by law.
9. General. This agreement is governed by South African law. It is the entire agreement on the service; changes must be in writing or electronically accepted.
